As a Teamster, you have rights that protect you on the job. Knowing those rights is the first step to making sure they are respected.
Your Right to Union Representation
Union members have the right to union representation during any conversation with a supervisor or manager that could lead to discipline. These rights have been upheld by the Supreme Court and are known as Weingarten Rights.
“If this discussion could in any way lead to me being disciplined, terminated or affect my personal working conditions, I request that a union steward, business agent or union officer be present at this meeting. Without representation, I choose not to answer any questions.”
Then remain silent. If you proceed, your rights will be waived.
Read the full Weingarten Rights page for more detail.
Your Right to Organize
Under the National Labor Relations Act (NLRA), you have the right to:
- Join or support a union
- Bargain collectively through representatives of your own choosing
- Act together with coworkers to improve wages and working conditions
- Choose not to engage in any of these activities
Protection from Retaliation
It is illegal for your employer to:
- Fire, demote, or discipline you for union activity
- Threaten you for exercising your rights
- Spy on or interrogate you about union activities
- Promise benefits to discourage union support
If you believe your rights have been violated, contact your steward or the union hall immediately at 619-282-2187.
Contract Enforcement
Stewards are the first people in line to enforce the contract and fight management bullying. Resources for stewards include Q&A guides, Just Cause principles, note-taking tips, and more. Visit the Steward Tools section on our resources page.
